  1. SCOPE AND CONSENT
    We respect the privacy rights of our users and are committed to protecting the information collected through our websites, platforms, services, tools, or products as explained in this Privacy Policy. “We” or “us” refers to StubHub, Inc. and its subsidiaries, parent companies, joint ventures, and other corporate entities under common ownership and/or any of their agents, consultants, employees, officers, and directors.
    This Privacy Policy applies to your use of the Ticket Utils website and any other related websites (the “Site”), mobile applications, platforms, tools, products or services (collectively, the "Services") where this Privacy Policy is referenced, regardless of how you access or use them. BY INSTALLING, USING, REGISTERING, OR OTHERWISE ACCESSING OUR SERVICES, YOU GIVE EXPLICIT CONSENT TO OUR COLLECTION, USE, DISCLOSURE AND RETENTION OF YOUR PERSONAL INFORMATION AS DESCRIBED IN THIS PRIVACY POLICY AND ENFORCED THROUGH OUR TERMS OF SERVICE. IF YOU DO NOT AGREE TO OUR POLICIES AND PRACTICES AS SET FORTH IN OUR PRIVACY POLICY AND TERMS OF SERVICE, PLEASE DO NOT INSTALL, USE, REGISTER FOR OR OTHERWISE ACCESS OUR SERVICES.

    This Privacy Policy describes:
    • The personal information we collect and how we use that information;
    • The choices you have about how we communicate with you and what personal information you share;
    • When we might disclose your personal information; and
    • How we retain and protect your personal information.

    • If you reside elsewhere your data controller is eBay International AG, Helvetiastrasse 15/17, 3005, Bern, Switzerland.

    Your data controller is responsible for the collection, use, disclosure, retention and protection of your personal information in accordance with our global privacy standards as well as any applicable laws. Your data controller may transfer data to other members of the eBay Inc. corporate family as described in this Privacy Policy. We may process and retain your personal information on our servers in the United States, the European Union, and elsewhere in the world where our data centers are located.
    • a)Personal Information Defined – “Personal information” is information that can be associated with a specific person and could be used to identify that specific person, whether directly from that data, or from that data combined with other information that we have or are likely to have access to. We do not consider personal information to include information that has been made anonymous or aggregated so that it can no longer be used to identify a specific person, whether in combination with other information or otherwise.
    • b)Changes to this Privacy Policy - We may change this Privacy Policy from time to time by posting the amended policy on this site. We advise you to read it regularly. All material changes automatically take effect 30 days after they are posted, or the next time you use the Services, whichever is sooner. Material changes to our Privacy Policy will be announced via email or notification within the Services. Please note that your continued use of our Services will signify your acceptance of the changes to the Privacy Policy.
    • c)Global Privacy Standards - Our parent company eBay Inc. has established global privacy standards for all eBay Inc. companies known as Binding Corporate Rules (BCRs). They are our commitment to protect your personal information and honor our privacy obligations regardless of where your personal information is collected, processed or stored. Our BCRs have been approved by a number of European Union privacy regulators.   2. COLLECTION
    We collect personal information from you and the devices (including mobile devices) you use to access or use our Services. This includes, but is not limited to, the kinds of personal information described below:

    a) Information You Provide when you use our Services or register for an account with us, including:
    1. 1.Registration and account information – including identifying and authenticating information such as your name, telephone number, email address, postal address, password, company name, job title, role, business contact information, and company profile picture; any updates to your profile, settings or communication preferences; and general geo-location information such as your time zone. For geo-location information that we receive from your mobile device, keep in mind that most mobile devices allow you to control or disable the use of location services within your settings’ menu. In addition, we securely store and process your log-in credentials for your accounts on any linked ticketing marketplaces that you link to your Ticket Utils account (“Linked Accounts”);
    2. 2.Financial information – such as credit card number, debit card number, expiration date, and billing information in connection;
    3. 3.Transactional information when interacting on or through our Services -including information relating to your use of the point-of-sale tool to list, sell or otherwise manage inventory or customers or any other transaction-related or other content you generate or that is connected to your account from using our Services; your transactions with other users through Broker Hub; information from your retail website created using our Services; and other similar information;
    4. 4.Information relating to your activities on Linked Accounts -including all actions taken through your Linked Accounts through the Services. For example, we receive information relating to your inventory, customers, listings, sales, fulfillment activities, usage and other transactional information when you transact through your Linked Accounts via the Service;
    5. 5.Information provided through your interactions with us: including information provided through user ratings and reviews, chats, discussions, blogs, dispute resolution, referral services, testimonials, surveys; information added to a web form or when adding/updating your account information; correspondence sent to us or otherwise made through our Site and Services; and customer service communications;
    6. 6.Other information to verify you or your account –we may collect and process additional information (as permitted by law) to authenticate you or your account, or to verify the information we have collected;
    b) Information We Collect Using Cookies, Web Beacons and Similar Technologies: We use cookies, web beacons and similar technologies to provide and improve our Services and to provide a safer experience. For example, we use cookies on certain pages of our Site, within our emails, and for Services requiring registration. This is done primarily for your benefit as cookies allow you to log on only once per session. Most cookies are automatically deleted at the end of a session. In addition, many browsers offer users the option of declining cookies. If you do not wish to accept cookies, please modify the settings in your browser. However, please be aware your browser must be set to accept cookies if you wish to use the Services available only to registered members. In addition, we may collect information about the ways you interact with our emails.     c) Information We Automatically Collect from Your Computer or Other Electronic Device: We also automatically collect information about your interaction with our Site and Services and communications. This is typically information we receive from your computer or other devices (including mobile devices) including web and database log information, IP address, the URL that you just came from, which URL you go to next, browser type, statistics on page views, traffic to and from the Site, device ID or unique identifier, your operating system, and other similar computer or connection information.

    d) Information We Collect from Other Sources (including but not limited to):
    1. 1.Information we Obtain from Third Parties –we may supplement the personal information we collect with additional information about you from third parties and link this to your account information. This information includes, but is not limited to: publicly available demographic data, publicly available contact data, credit check data from credit bureaus, and additional data about you from other sources, such as public authorities, to the extent permitted by law.
    2. 2.Information we Get from Third Party Social Networking or Sign-in Services – we may allow you to use social networking services, such as Facebook, Instagram, Google Plus and Twitter, that enable you to create your account, share information, or to connect your account with the respective social networking services. Those social networking services that enable you to access our Services may automatically give us access to certain personal information retained by them about you (e.g., content viewed by you, content liked by you, and information about the advertisements you have been shown or may have clicked on, etc.). You control the personal information you allow us to have access to through the privacy settings on the applicable social networking service and the permissions you give us when you grant us access to your personal information retained by the respective social networking service about you. By associating an account managed by a social networking service with your account and authorizing us to have access to this information, you agree that we may collect, use and retain the information provided by these social networking services in accordance with this Privacy Policy.
    3. 3.Information Other Users May Provide Us About You – other users must get your consent before providing us with your information. If another user gives us information about you, such as when providing a referral, they must tell you about our collection, use, disclosure and retention policies before giving us the information. Similarly, if you provide us with information about someone else, you must do so with their consent and by informing them that the data will be treated in accordance with this Privacy Policy.
  3. USE AND RETENTION
    We will only use your personal information in a manner consistent with this Privacy Policy and to do the following:

    1. a)Operate, Improve and Personalize the Services: to provide you use of and access to our Services, manage your account, monitor your use of the Services and other features or functionalities, give you access to communication tools or other features and functionalities; develop, customize, personalize, measure and improve our Services and any other StubHub services, tools, features, products, applications, websites, other functionalities or offerings; better understand our users, provide other services requested by you as described when we collect the information and to otherwise use the personal information you provide to generally manage the Services, other StubHub offerings and our overall business;
    2. b)Contact You and Provide You Customer Services: to provide you the customer service you request relating to the Services or other products StubHub or our corporate family; make decisions about your eligibility for certain Services upon your request to use such Services, contact you by postal mail, email or phone relating to your account or the Services, resolve disputes, collect fees, poll your opinions, and for other purposes authorized by law and consistent with this Privacy Policy.     3. c)Detect, Prevent and Mitigate Fraudulent or Illegal Activities: to enforce our Terms of Service and any other applicable policies or agreements between you and StubHub, to prevent, detect, investigate and report fraud, security breaches, potentially prohibited or illegal activities; to protect the security or integrity of our sites and Services; to protect against, identify or address wrongdoing; and to compare the personal information you provide for accuracy, and verify it with information provided by third parties as necessary.
    4. d)Marketing: based on your communication preferences, to contact you for our marketing or advertising purposes, including without limitation, to inform you about services or products we believe might be of interest to you, to support your request for information about products or services offered by members of our corporate family, to develop promotional or marketing materials and provide those materials to you, and to display content and advertising on or off the Services that we believe might be of interest to you.     5. e)Other Purposes –for accounting and litigation purposes and any other purposes consistent with this Privacy Policy. If we intend to use any personal information in a manner that is not consistent with this Privacy Policy, you will be informed of such anticipated use prior to or at the time the personal information is collected or we will obtain your consent subsequent to such collection but prior to such use.
      We retain your personal information as long as it is necessary and relevant for our operations. Upon request, personal information from closed accounts will be deleted or rendered anonymous as soon as reasonably possibly after the account is closed or deactivated. Under certain circumstances we may retain personal information from closed accounts to prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigation, enforce our Terms of Service or other policies, comply with applicable legal data retention obligations and take other actions permitted by law. After it is no longer necessary for us to retain your personal information, we will dispose of it in a secure manner according to our data retention and deletion policies.
  4. CHOICE
    You have a choice about what personal information we receive and how we can use your personal information as explained below:

    1. a)Communication Preferences - We do not sell or rent your personal information to third parties for their marketing purposes without your explicit consent. Our Services provide you the opportunity to opt-out of receiving marketing communications. To opt-out of receiving marketing communications, you can do so by updating your preferences within "My Account" and “My Information” (deselect the “Receive Product Updates” checkbox); you can unsubscribe from the link within the email communication, or you can email support@ticketutils.com and indicate your desire to stop receiving marketing communications. Please note that active users cannot opt-out of communications necessary to provide our services (e.g. confirmation emails, critical service updates, transactional emails, customer service responses, etc.). In addition, you may schedule reminders using the Service and update your preferences when logged into your account.
    2. b)Linked Accounts – You control what information you share with us relating to Linked Accounts by unlinking a Linked Account at any time. To manage your Linked Accounts, you must log into your account and you can review or edit your Linked Accounts (including your credentials and configuration parameters) within “Sync Center” and “Sync Stats” by selecting the “Configure” option. In addition, you control what information is received by the ticketing marketplaces based on how you interact with those marketplaces through your Linked Accounts and based on your settings within those marketplaces. Your personal information will be shared through your Linked Account with the associated ticket marketplace only if you list and sell your tickets for sale on such ticket marketplace. Also, the privacy policy of the ticket marketplace will govern how it collects, uses and shares your information. If you do not list your inventory on a ticket marketplace, your information will not be shared through your Linked Accounts.     3. c)Staying Signed In –When you sign in to your account on our Services, we may give you the option to stay signed in to your account for a certain period of time. If you are using a public or shared computer, we encourage you not to choose to stay signed in. You or any other user of the computer/browser you signed in on will be able to view and access most parts of your account and take certain specific actions during this signed in period without any further authorization.
  5. ACCESS AND DELETION
    We take steps to ensure that the personal information we collect is accurate and that you have the ability to access or correct it.
    • a) You can see, review and change most of your personal information by signing on to your account and editing the information within the My Account, My Information and Billing Information sections of the Site. Please update your personal information immediately if it changes or is inaccurate.
    • b) Once you make a public posting, you may not be able to change or remove it. Upon your request, we will close your account and remove your personal information from view as soon as reasonably possible, based on your account activity and in accordance with applicable law.
    • c) We will honor any statutory right you might have to access, modify or erase your personal information. You can email us at legal@ticketutils.com to request access. Where you have a legal right to request access or request the modification or erasure of information, we can still withhold that access or decline to correct information in some cases in accordance with applicable law, but will give you reasons if we do so.
  6. DISCLOSURE OF INFORMATION
    We disclose your personal information to respond to legal requirements, enforce our policies, respond to claims that content violates the rights of others, or protect the rights, property or safety of any member of the eBay Inc. corporate family, other users or third parties. Such information will be disclosed only in accordance with applicable laws and regulations (such as professional secrecy obligations). We minimize the amount of personal information we share to what is directly relevant and necessary to accomplish the specified purpose. We do not disclose your personal information to third parties for their marketing purposes without your explicit consent.
    We may disclose your personal information with the following third parties for the purposes described below:
    1. a) Members of the eBay Inc. corporate family –to provide joint content and services (such as registration, transactions and customer support); prevent, detect and investigate possible illegal activities, violations of our policies, fraud and/or data security breaches; and support decision making on their products, websites, applications, services, tools and communications. Please keep in mind that other eBay Group companies will not directly send you marketing messages unless you have consented to receiving their communications. They will use your personal information in accordance with their respective privacy policies and our global privacy standards.
    2. b)Third party service providers, payment processors and financial institutions under contract who help with our business operations (such as, but not limited to, fraud detection and investigations, identity verification services, payment processing, bill collection, website operations, information security services, fulfilment and delivery services).
    3. c)Other users (e.g. in Broker Hub): whether located in your country of residence or outside of your country of residence, as necessary or appropriate for a transaction or as authorized by your use of our Services.
    4. d)Other third parties to whom you explicitly ask us to send your information (or about whom you are otherwise explicitly notified and consent to when using a specific service).
    5. e)Local and foreign law enforcement or regulatory agencies, other government officials or authorized third-parties, in response to a verified request relating to a criminal investigation (i.e. a subpoena, court order or substantially similar legal procedure) or alleged illegal activity or any other activity that may expose us, you, or any other StubHub user to legal liability. In such events, we will disclose information relevant and necessary to the investigation or inquiry, such as name, address, telephone number, email address, IP address, fraud complaints, sales and/or purchase history or payment transaction history.
    6. f)Credit bureaus to which we might report information about your account, including information on late fee payments, missed fee payments or other defaults on your account that may be reflected in your credit report, as allowed by applicable law.
    While we use contractual and other measures to ensure protection of personal information, the laws and regulations relating to privacy and personal information protection in other jurisdictions may not be the same as, or similar to, your local privacy laws. The governments, courts, law enforcement or regulatory agencies in these other jurisdictions may be able to request disclosure of personal information through the laws of these countries. In an effort to respect your privacy, we will not otherwise disclose your personal information to law enforcement, other government officials, or other third parties without a subpoena, court order or substantially similar legal procedure, except when we believe in good faith that the disclosure of information is necessary to prevent imminent physical harm, financial loss or to report potentially illegal or fraudulent activity.If we were to merge with or be acquired by another company, we may share information with them in accordance with our Global Privacy Standards. Should such an event occur, we will require that the new combined entity follow this Privacy Policy with respect to your personal information. If your personal information will be used or disclosed for any purposes not covered in this Privacy Policy, you will receive prior notification of the use of your personal information for the new purposes.
  7. SECURITY
    We protect your information using technical and administrative security measures to reduce the risks of loss, misuse, unauthorized access, disclosure and alteration. Some of the safeguards we use are firewalls and data encryption, physical access controls to our data centers, and information access authorization controls. However, please keep in mind that no network, server, database or Internet or e-mail transmission is ever fully secure or error free. Therefore, you should take special care in deciding what information you send to us electronically and you do so at your own risk.
  8. OTHER IMPORTANT INFORMATION
    1. a)Unwanted or Threatening Email – Sending unwanted or threatening email is against our policies. To report Ticket Utils-related spam or spoof emails please forward the email to safety@stubhub.com.
    2. b)Children’s Privacy – Our websites are general audience websites, and our Services are not intended for users under the age of 18. We do not knowingly collect personal information from users in this age group.
    3. c)Linked Accounts and Third-Party Privacy Practices – This Privacy Policy addresses only our use and disclosure of personal information we collect from you through the Services. If you disclose your information to others, such as when using Broker Hub or when listing or transacting through a Linked Account, that party’s privacy policies and practices will apply. We cannot guarantee the privacy or security of your information once you provide it to a third party and we encourage you to evaluate the privacy and security policies of any third party before entering into a transaction and choosing to share your information. For instance, if you chose to list and sell tickets through your Linked Account with a third-party ticket marketplace, that marketplaces’ privacy policy will apply to the personal information you share. Similarly, when you list and sell tickets through your Linked Account with StubHub (on the StubHub ticket marketplace), the StubHub User Privacy Notice will govern how your personal information that you provide is used and shared.
